These Terms of Service apply to anyone who enrolls in and accesses our services. By booking a session, participating in an activity, or indicating agreement to these Terms of Service, you acknowledge that you have read, understood, and agree to comply with them.

PERSONS UNDER THE AGE OF 18

Our services are primarily designed for persons between the ages of 5 and 17. We provide services to minors where a parent or legal guardian agrees to these terms and conditions on their behalf.

DEEMED ACCEPTANCE

By accessing or using our services, you accept these Terms of Service, which, along with our Privacy Policy, form a binding contractual agreement with you.

CONDITIONS OF PARTICIPATION

We reserve the right to refuse service or participation for safety concerns or non-compliance with these terms.

CANCELLATION, REFUNDS & RESCHEDULING

Payments for a full term are non-refundable. Participants are committed to the entire term, ensuring consistent group dynamics. Participants opting for weekly payments must commit to the entire term, even if unable to attend some sessions. No refunds will be provided for missed weeks. Credits for future activities may be considered in exceptional circumstances at our discretion.

RECREATIONAL RISK WARNING

You acknowledge that our services involve risks and participate voluntarily at your own risk. This includes understanding risks associated with any pre-existing health conditions.

LIABILITY WAIVER

You waive and release us from any claims arising from your participation in our services, except in cases of gross negligence or intentional misconduct.

PURCHASE AND PAYMENT

Fees for services are outlined on our website and must be paid in advance, unless expressed otherwise. Payment terms are as prescribed on our website. We reserve the right to exclude participants who have not paid fees.

COPYRIGHT AND USAGE

Intellectual property rights in our services are owned by ADVENTURE MINDS PTY LTD. You may not use our content for commercial purposes without our permission.

UPDATES TO TERMS

We may update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new terms.

SEVERABILITY

If any part of these Terms of Service is deemed invalid, the remainder will continue to be valid.

You are expressly advised and you acknowledge that the services and activities offered by ADVENTURE MINDS PTY LTD carry risks, including the risk of personal injury. You agree to participate at your own risk.

In this Agreement, "our Services" includes but is not limited to the workshops, seminars, adventure activities, outdoor exploration, and any other activities as detailed in our program descriptions. "Injury" means all forms of physical, mental, and emotional injury related to these services, including but not limited to breaks, strains, lacerations, dislocations, dehydration, trauma, anxiety, and death.

Our Services are designed for use by persons aged 5 to 17 years, as well as adults. We provide our Services to minors where a parent or legal guardian agrees to these terms and conditions on behalf of the Minor. If we are not satisfied that a parent or legal guardian has agreed to these terms on behalf of a Minor, we may choose not to commence providing our Services or may suspend and/or cease providing our Services.

IN CONSIDERATION OF US ALLOWING YOU TO PARTICIPATE IN THE SERVICES, YOU ACKNOWLEDGE, UNDERSTAND, AND ARE AWARE THAT:

You have voluntarily chosen to participate in the services provided by us. You understand the inherent risks in these activities and willingly assume full responsibility for any risks and accept full responsibility for any injury that may result from participation.

Participation is entirely voluntary. You are not obligated to participate in any service you do not wish to do and may refuse participation or end participation at any time. You agree to notify us of any pre-existing medical conditions prior to the start of services.

You agree to waive any and all claims against ADVENTURE MINDS PTY LTD, its directors, officers, employees, agents, volunteers, and contractors for any loss, damage, injury, or expense you may suffer as a result of participation in our services due to any cause, including negligence.

This Agreement shall be binding upon you, your successors, representatives, executors, assigns, or transferees. If any portion of this Agreement is held invalid, the remainder shall remain in full legal force and effect.

You give us permission and authority to arrange for emergency medical services for you should you become injured, understanding you are responsible for any expenses incurred.

EMERGENCY PROCEDURES AND SAFETY MEASURES

We have established emergency procedures and safety measures for all activities. These include:

Ensuring safe and appropriate conduct of activities in line with best practice standards.Having a plan for managing emergencies, including access to first aid and contacting emergency services if required.Regularly reviewing and updating our safety and emergency procedures.

PARENTAL/GUARDIAN RESPONSIBILITIES

For participants who are minors, parents or guardians are responsible for:

Communicating with the facilitator about their whereabouts before and after sessions if they are late.Ensuring their child is prepared for activities, including bringing necessary items as listed in the program descriptions.

DATA PROTECTION AND PRIVACY

Participant data will be collected, stored, and used in accordance with our Privacy Policy, which is available upon request. This policy outlines how we protect your personal information and respect your privacy.

ACKNOWLEDGMENT

By agreeing to this waiver, you acknowledge that you have read, understood, and agree to the terms and conditions outlined above.

Adventure Minds is committed to providing a safe, supportive, and engaging environment for all participants. Our Code of Conduct outlines the expectations for behavior and interaction among participants, parents, and staff. By enrolling in our programs, you agree to adhere to these standards.

Respect for Others

- Treat all participants, parents, and staff with respect and kindness.
- Refrain from using language or behavior that is abusive, discriminatory, or offensive.
- Listen actively and communicate openly and honestly.

Zero Tolerance for Abusive Behavior

We have a zero tolerance for abusive behavior between parents within the community. Any form of abusive language or behavior will be addressed immediately and may result in removal from the program.

Participation and Commitment

- Ensure regular attendance and punctuality for all sessions.
- Participate actively in all activities and encourage others to do the same.
- Be open to new experiences and give your best effort in all program activities.

Safety and Wellbeing

- Follow all safety guidelines and instructions provided by staff.
- Respect the physical and emotional boundaries of others.
- Notify staff immediately of any safety concerns or incidents.

Community and Collaboration

- Support and encourage fellow participants, fostering a positive and inclusive community.

ADVENTURE MINDS GRIEVANCE POLICY

Introduction
Adventure Minds is committed to addressing any grievances or concerns in a fair, transparent, and timely manner. This policy outlines the process for raising and resolving grievances.

Grievance Submission

Grievances should be submitted in writing to the program coordinator.Include a detailed description of the issue, relevant dates, and any supporting documentation. Grievances should be submitted within 30 days of the incident.

Grievance Process:

Acknowledgment

The program coordinator will acknowledge receipt of the grievance within five business days.

Review and Investigation

The grievance will be reviewed, and if necessary, an investigation will be conducted. This may involve speaking with all parties involved and reviewing any relevant documentation.

Resolution

A proposed resolution will be provided in writing within 15 business days of the grievance acknowledgment. If additional time is required, the coordinator will inform the complainant of the delay and provide an estimated resolution timeframe.

Appeal

If the complainant is not satisfied with the resolution, they may appeal in writing within 10 business days. The appeal will be reviewed by a senior staff member or a designated independent party. A final decision will be provided within 10 business days of receiving the appeal.

Zero Tolerance for Abusive Behavior

We have a zero tolerance for abusive behavior between parents within the community.
The grievance policy is necessary to address any such behavior and maintain a respectful environment.

Confidentiality

All grievances will be handled confidentially, with details shared only with those directly involved in the resolution process.

Non-Retaliation

Participants, parents, and staff can raise grievances without fear of retaliation. Any form of retaliation will be addressed promptly and may result in disciplinary action.
